DECISION OF THE EEA JOINT COMMITTEE No 146/2020

of 23 October 2020

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2023/1721]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2019/1895 of 7 November 2019 recognising several islands in Portugal as free from varroosis and amending the Annex to Implementing Decision 2013/503/EU (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland.

(3)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary mattersshall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(4)

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 59 (Commission Implementing Decision 2013/503/EU) in Part 7.2 of Chapter I of Annex I to the EEA Agreement:

‘—

32019 D 1895: Commission Implementing Decision (EU) 2019/1895 of 7 November 2019 (OJ L 291, 12.11.2019, p. 54).’

Article 2

The text of Implementing Decision (EU) 2019/1895 in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 24 October 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE No 147/2020

of 23 October 2020

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2023/1722]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2020/147 of 3 February 2020 concerning the authorisation of the preparation of Saccharomyces cerevisiae CNCM I-4407 as a feed additive for weaned piglets, sows (in order to have a benefit for suckling piglets) and dairy cows and amending Regulations (EC) No 2148/2004, (EC) No 1288/2004 and (EC) No 1811/2005 (holder of authorisation S.I. Lesaffre) (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(3)

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

1.

The following indent is added in points 1zt (Commission Regulation (EC) No 1288/2004), 1zze (Commission Regulation (EC) No 2148/2004) and 1zzr (Commission Regulation (EC) No 1811/2005):

‘—

The following point is inserted after point 312 (Commission Implementing Regulation (EU) 2019/1977):

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2020/228 of 19 February 2020 concerning the authorisation of erythrosine as a feed additive for dogs and cats (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Regulation (EU) 2020/229 of 19 February 2020 concerning the authorisation of L-tryptophan as a feed additive for all animal species (2) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Regulation (EU) 2020/238 of 20 February 2020 concerning the authorisation of L-threonine as a feed additive for all animal species (3) is to be incorporated into the EEA Agreement.

(4)

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2020/196 of 13 February 2020 concerning the renewal of the authorisation of endo-1,4-beta-xylanase produced by Aspergillus niger CBS 109.713 as a feed additive for chickens for fattening, turkeys for fattening, turkeys reared for breeding, minor avian species (except laying birds) and ornamental birds and repealing Regulations (EC) No 1380/2007, (EC) No 1096/2009 and Implementing Regulation (EU) No 843/2012 (holder of authorisation BASF SE) (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Regulation (EU) 2020/197 of 13 February 2020 concerning the authorisation of allura red AC as a feed additive for cats and dogs (2) is to be incorporated into the EEA Agreement.

(3)

Implementing Regulation (EU) 2020/196 repeals Commission Regulations (EC) No 1380/2007 (3), (EC) No 1096/2009 (4) and Commission Implementing Regulation (EU) No 843/2012 (5), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(4)

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The texts of Implementing Regulations (EU) 2020/196 and (EU) 2020/197 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 24 October 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/1725]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2020/1341 of 28 September 2020 amending Implementing Regulation (EU) 2020/466 as regards the period of application of temporary measures (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding veterinary matters, feedingstuffs and foodstuffs. Legislation regarding veterinary matters, feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(3)

Annexes I and II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in points 11c (Commission Implementing Regulation (EU) 2020/466) in Part 1.1 of Chapter I and 31r (Commission Implementing Regulation (EU) 2020/466) of Chapter II of Annex I to the EEA Agreement:

Commission Implementing Regulation (EU) 2020/239 of 20 February 2020 amending Implementing Regulation (EU) No 901/2014 with regard to the adaptation of the templates for type-approval procedures for two- or three-wheel vehicles and quadricycles to the environmental steps Euro 5 and Euro 5+ requirements (1) is to be incorporated into the EEA Agreement.

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

Commission Implementing Regulation (EU) 2019/2093 of 29 November 2019 amending Regulation (EC) No 333/2007 as regards the analysis of 3-monochloropropane-1,2-diol (3-MCPD) fatty acid esters, glycidyl fatty acid esters, perchlorate and acrylamide (1) is to be incorporated into the EEA Agreement.

(2)

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Commission Implementing Regulation (EU) 2020/910 of 30 June 2020 amending Implementing Regulations (EU) 2015/1998, (EU) 2019/103 and (EU) 2019/1583 as regards the re-designation of airlines, operators and entities providing security controls for cargo and mail arriving from third countries, as well as the postponement of certain regulatory requirements in the area of cybersecurity, background check, explosive detection systems equipment standards, and explosive trace detection equipment, because of the COVID-19 pandemic (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision C(2020) 4241 of 30.6.2020 amending Commission Implementing Decision C(2019) 132 Final as regards the postponement of some regulatory requirements in the area of background check because of the COVID-19 pandemic is to be incorporated into the EEA Agreement.

(3)

Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Directive (EU) 2017/1564 of the European Parliament and of the Council of 13 September 2017 on certain permitted uses of certain works and other subject matter protected by copyright and related rights for the benefit of persons who are blind, visually impaired or otherwise print-disabled and amending Directive 2001/29/EC on the harmonisation of certain aspects of copyright and related rights in the information society (1) is to be incorporated into the EEA Agreement.

(2)

Annex XVII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XVII to the EEA Agreement shall be amended as follows:

The following is added in point 9e (Directive 2001/29/EC of the European Parliament and of the Council):

amending Annex XX (Environment) to the EEA Agreement [2023/1743]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Regulation (EU) 2019/631 of the European Parliament and of the Council of 17 April 2019 setting CO2 emission performance standards for new passenger cars and for new light commercial vehicles, and repealing Regulations (EC) No 443/2009 and (EU) No 510/2011 (1) is to be incorporated into the EEA Agreement.

(2)

Regulation (EU) 2019/631 repeals, with effect from 1 January 2020, Regulations (EC) No 443/2009 (2) and (EU) No 510/2011 of the European Parliament and of the Council (3), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(3)

Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XX to the EEA Agreement shall be amended as follows:

1.

The following point is inserted after point 21ayf (Commission Implementing Decision (EU) 2019/313):

‘21az.

32019 R 0631: Regulation (EU) 2019/631 of the European Parliament and of the Council of 17 April 2019 setting CO2 emission performance standards for new passenger cars and for new light commercial vehicles, and repealing Regulations (EC) No 443/2009 and (EU) No 510/2011 (OJ L 111, 25.4.2019, p. 13).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

(a)

The following subparagraph shall be added in Article 6(2):

“If the pool includes only manufacturers established in the EFTA States, the manufacturers shall file the information with the EFTA Surveillance Authority. If the pool includes at least one manufacturer established in the Union and at least one manufacturer established in the EFTA States, the manufacturers shall file the information with the Commission and the EFTA Surveillance Authority.”

(b)

The following subparagraph shall be added in Article 6(3):

“The EFTA Surveillance Authority shall notify manufacturers established in the EFTA States.”

(c)

The following subparagraph shall be added in Article 6(4):

“If the pool includes only manufacturers established in the EFTA States, the manufacturers shall jointly inform the EFTA Surveillance Authority. If the pool includes or is extended to include at least one manufacturer established in the Union and at least one manufacturer established in the EFTA States, the manufacturers shall jointly inform both the Commission and the EFTA Surveillance Authority.”

(d)

In Article 6(5) the words “Articles 101 and 102 TFEU” shall read “Articles 53 and 54 of the EEA Agreement” and the word “Union” shall read “EEA”.

(e)

In Article 6(7), the words “or the EFTA Surveillance Authority” shall be inserted after the word “Commission”.

(f)

The data reported by the EFTA States shall also be kept in the central register referred to in Article 7(4).

(g)

The following subparagraph shall be added in Article 7(4):

“The EFTA Surveillance Authority shall make the calculations set out in subparagraph 1 for manufacturers established in the EFTA States and notify each manufacturer established in the EFTA States in accordance with the second subparagraph.”

(h)

Without prejudice to Protocol 1 to the Agreement, in Article 7(5) and Article 10(3), (4), (5) and (6), the words “or the EFTA Surveillance Authority, as the case may be,” shall be inserted after the word “Commission”.

(i)

The following subparagraphs shall be added in Article 8(1):

“Where the manufacturer or pool manager is established in an EFTA State, the EFTA Surveillance Authority shall impose the excess emissions premium.

The amounts of the excess emissions premium shall be distributed between the Commission and the EFTA Surveillance Authority proportionally to the share of the registrations of new passenger cars or new light commercial vehicles registered in the EU or in the EFTA States, respectively, relative to the total number of new passenger cars or new light commercial vehicles registered in the EEA.”

(j)

The following subparagraphs shall be added in Article 8(3):

“The European Commission shall use its established means for collecting excess emissions premiums under paragraph 1 also in relation to the registrations in EFTA States of manufacturers established in the EU.

The EFTA Surveillance Authority shall determine the means for collecting excess emissions premiums under paragraph 1. These means shall be based on the Commission’s means.”

(k)

The following subparagraph shall be added in Article 8(4):

“For the EFTA States, the EFTA States shall determine the allocation of the amounts of the excess emissions premium.”

(l)

In Article 9(1), the following shall be inserted after the words “the Commission”: “and the EFTA Surveillance Authority, as regards manufacturers established in the EFTA States,”.

(m)

Without prejudice to Protocol 1 to the Agreement, in Article 10(2) and (4) second subparagraph, the words „, or, in the case of a manufacturer established in the EFTA States, to the EFTA Surveillance Authority,” shall be inserted after the word “Commission”.

(n)

The following subparagraph shall be added in Article 11(2):

“Suppliers or manufacturers established in the EFTA States shall send applications pursuant to this Article to the Commission. The Commission shall give the same priority to such applications as to other applications pursuant to this Article.”

(o)

The following subparagraph shall be added in Article 11(4):

“Commission Decisions approving innovative technologies pursuant to this Article are generally applicable and shall be incorporated into the EEA Agreement.”

(p)

This Regulation shall not apply to Liechtenstein.”

2.

The texts of points 21ae (Regulation (EC) No 443/2009) and 21ay (Regulation (EU) No 510/2011) are deleted.

Article 2

The text of Regulation (EU) 2019/631 of in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 24 October 2020, or on the day following the last notification to the EEA Joint Committee under Article 103(1) of the EEA Agreement, whichever is the later (*1).

It is appropriate to continue the cooperation of the Contracting Parties to the EEA Agreement in Union actions funded from the general budget of the Union regarding the preparatory action on defence research.

(2)

Protocol 31 to the EEA Agreement should therefore be amended in order to allow for that extended cooperation to take place from 1 January 2020,

It is appropriate to continue the cooperation of the Contracting Parties to the EEA Agreement in Union actions funded from the general budget of the Union regarding the free movement of workers, coordination of social security schemes and measures for migrants, including migrants from third countries.

Article 2

This Decision shall enter into force on the day following the last notification under Article 103(1) of the EEA Agreement (*1).

It shall apply from 1 January 2020.

DECISION OF THE EEA JOINT COMMITTEE No 175/2020

of 23 October 2020

amending Protocol 31 to the EEA Agreement, on cooperation in specific fields outside the four freedoms [2023/1750]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Articles 86 and 98 thereof,

Whereas:

(1)

It is appropriate to continue the cooperation of the Contracting Parties to the EEA Agreement in Union actions funded from the general budget of the Union regarding company law.

(2)

Protocol 31 to the EEA Agreement should therefore be amended in order to allow for that extended cooperation to take place from 1 January 2020,

HAS ADOPTED THIS DECISION:

Article 1

In paragraph 13 of Article 7 of Protocol 31 to the EEA Agreement, the words “and 2019” are replaced by the words “, 2019 and 2020”.

Article 2

This Decision shall enter into force on the day following the last notification under Article 103(1) of the EEA Agreement (*1).

It shall apply from 1 January 2020.

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE No 176/2020

of 30 October 2020

amending Annex XIII (Transport) to the EEA Agreement [2023/1751]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2020/1477 of 14 October 2020 amending Council Regulation (EEC) No 95/93 as regards the temporary extension of exceptional measures to address the consequences caused by the COVID-19 pandemic (1) is to be incorporated into the EEA Agreement.

(2)

Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in point 64b (Council Regulation (EEC) No 95/93) of Annex XIII to the EEA Agreement:

‘—

32020 R 1477: Commission Delegated Regulation (EU) 2020/1477 of 14 October 2020 (OJ L 338, 15.10.2020, p. 4).’

Article 2

The text of Delegated Regulation (EU) 2020/1477 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 30 October 2020, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
